An untested question under Oregon law

Oregon has never prosecuted a parent over a child’s mass shooting, according to The Oregonian/OregonLive. No prosecution of the Bend gunman’s mother has been announced in connection with the attack at Silver Rail Elementary School.

The Oregonian/OregonLive consulted 12 legal experts, who agreed that Oregon law could expose the mother to prison only if prosecutors established egregious conduct, such as disregarding warning signs. The reporting does not establish that she ignored such signs.

Giamanco’s account of the final confrontation

Kaylub Giamanco, 36, told Oregon Public Broadcasting that he saw an armed teenager at the school attended by his two daughters and retrieved a gun from his truck’s center console. Hearing gunfire and children calling for help, he moved toward the damaged building and crawled into an entryway through the lower part of a broken window.

Giamanco said he approached a special-needs classroom and looked through a window. Inside, he saw a teacher struggling with the gunman, who was holding a rifle and appeared unaware of Giamanco’s presence. Giamanco said he opened the door, entered and fired, killing the teenager.

Police identified the attacker as Griffin J. John II, a 16-year-old former student. They said he forced his way through locked doors with a shotgun. Police said Giamanco was carrying his gun legally and credited him and the unarmed teacher who confronted the attacker with saving lives.

Three children, aged 5, 8 and 11, and a teacher were killed. Another student was critically injured, and another teacher was injured and hospitalized. The BBC reported that Giamanco has expressed anguish over the children he could not save.
